The Union Ministry of Health and Family Welfare has proposed amendments to the Drugs Rules, 1945, to allow for the immediate suspension of manufacturing licences for medicines declared Not of Standard Quality on specified critical parameters. According to the Ministry, the changes aim to prevent the continued manufacture and distribution of substandard drugs and remove procedural delays caused by existing show-cause notice requirements.
Under the proposed framework, the Central Licensing Approving Authority or State Licensing Authority can immediately suspend a licence upon receiving a Government Analyst’s report showing deficiencies in assay, dissolution, related substances, impurities, or sterility. The suspension will remain in place until the manufacturer completes a root cause analysis and implements verified corrective and preventive actions.
Additionally, the amendments introduce an enhanced reporting mechanism where test reports will be endorsed to the Drugs Controller General of India, state licensing authorities, and the concerned manufacturers and marketers. The draft rules have been opened for public consultation, inviting objections and suggestions from stakeholders within 30 days of notification.
What it means
- Suspended licences will only be restored after manufacturers complete root cause analysis and implement verified corrective and preventive actions.
- Stakeholders and the public can submit objections and suggestions to the draft amendments within 30 days.
